Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Only24 loyalty and rewards platform, including our website, app, and related services (the "Service"), operated by EkoMade Labs LLC ("Only24", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Only24 lets a business ("Shop") run a rewards program in which customers earn rewards for posting Instagram stories or posts that tag the Shop. When a tag is detected, Only24 credits the reward the Shop has configured, subject to the Shop's settings and the "one reward per customer per 24 hours" rule.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the information you provide, for maintaining the confidentiality of your account credentials, and for all activity under your account. You agree to provide accurate information and to keep it up to date.

3. Subscription and billing

• The Service is offered on a subscription basis at $49 per month per Shop, unless otherwise agreed in writing.
• Payments are processed by our payment provider, Stripe. By subscribing, you authorize recurring monthly charges to your payment method until you cancel.
• You may cancel at any time through the billing portal; cancellation stops future renewals. Except where required by law, payments already made are non-refundable.
• Applicable taxes may be added. Prices may change with reasonable notice.

4. Instagram and Meta compliance

To use mention detection, you connect an Instagram professional (business or creator) account through Instagram Login. You represent that you own or are authorized to manage that account, and you authorize Only24 to receive story mentions of your Shop and to send one automated reward reply from your account to each customer who mentions you. Your use of Instagram through the Service must comply with Meta's terms and policies. We are not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc.

5. Acceptable use

You agree not to misuse the Service, including by: violating any law or third-party rights; running rewards that are deceptive, unlawful, or that require the purchase of restricted goods; attempting to gain unauthorized access to the Service; interfering with its operation; or using it to harass or harm others. You are solely responsible for the rewards you offer and for honoring them.

6. Your content and data

You retain ownership of your business content. You grant us the limited rights needed to operate the Service on your behalf, such as processing Instagram mentions to credit rewards. Our handling of personal information is described in our Privacy Policy.

7. Intellectual property

The Service, including its software, design, and the Only24 name and logo, is owned by EkoMade Labs LLC and protected by law. These Terms do not grant you any right to our trademarks or to copy or resell the Service.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that every Instagram mention will be detected, as detection depends on third-party platforms outside our control.

9. Limitation of liability

To the maximum extent permitted by law, EkoMade Labs LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three months before the claim arose.

10. Indemnification

You agree to indemnify and hold harmless EkoMade Labs LLC from claims, damages, and expenses arising out of your use of the Service, the rewards you offer, or your violation of these Terms or applicable law.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that risks harm to others or to us. Upon termination, your right to use the Service ends; sections that by their nature should survive will survive.

12. Governing law

These Terms are governed by the laws of the State of Delaware and, where applicable, the State of New York, without regard to conflict-of-law rules. Disputes will be resolved in the courts located in those jurisdictions, unless applicable law requires otherwise.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date above and, where appropriate, notify Shops. Continued use of the Service after changes means you accept the updated Terms.
